Content Provider Agreement

1. Eligibility and Age Verification

1.1 Minimum Age Requirement

You must be at least 18 years of age to become a Content Provider on Kink.io. By agreeing to this Agreement, you represent and warrant that you are 18 years or older.

1.2 Identity Verification

Before you can upload or publish content, you must provide:

• A clear, legible copy of a valid government-issued photo ID (driver's license, passport, or state ID)
• A selfie photograph holding your ID next to your face
• Proof of address (if required)
• Any additional documentation we deem necessary to verify your identity and age

Your account will not be approved for content creation until verification is complete. We reserve the right to request additional verification at any time.

1.3 Persons Depicted in Content

All persons depicted or appearing in any content you upload must:

• Be at least 18 years of age at the time the content was created
• Have provided valid identification verifying their age
• Have provided written consent to appear in the content
• Have provided consent for the content to be distributed on this platform

2. Record-Keeping Requirements (18 U.S.C. § 2257)

2.1 Federal Compliance

As a Content Provider creating adult content, you are subject to the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75. You must maintain records proving that all persons depicted in your content are 18 years of age or older.

2.2 Records You Must Maintain

For each person appearing in your content, you must maintain:

• Legal name and any aliases or stage names used
• Date of birth
• A copy of valid government-issued identification showing date of birth
• Written consent and model release forms

These records must be maintained for a minimum of seven (7) years and must be available for inspection by authorized law enforcement or regulatory agencies.

2.3 Custodian of Records

By uploading content, you certify that you are the custodian of records for that content or that you have delegated custodian responsibilities to a designated agent. You must provide custodian of records information upon request.

3. Content Ownership and License

3.1 Your Ownership

You retain all ownership rights to the content you create and upload. However, by uploading content to Kink.io, you grant us certain rights as described below.

3.2 License to Platform

By uploading content, you grant Kink.io a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

• Host, store, reproduce, and display your content
• Distribute your content to users who have subscribed or paid to access it
• Create derivative works for the purpose of formatting or optimizing content delivery
• Use your content for promotional purposes (with your explicit consent)

3.3 Content Removal

You may remove your content at any time through your account settings. Upon removal, we will cease distribution of the content, though copies may remain in backups for a reasonable period.

4. Consent and Model Releases

4.1 Required Consents

For any person appearing in your content (including yourself), you must obtain and maintain:

• Written consent to be depicted in the content
• Consent for the content to be published and distributed on adult platforms
• Model release forms granting rights to use their likeness
• Acknowledgment that they understand the content is adult-oriented and may be sexually explicit

4.2 Withdrawal of Consent

If any person appearing in your content withdraws their consent, you must immediately remove the content from the platform and notify us.

5. Prohibited Content

You may not upload or create content that:

• Depicts or appears to depict minors (persons under 18)
• Depicts illegal activities
• Depicts non-consensual acts or sexual violence
• Contains bestiality or animal abuse
• Contains extreme violence, gore, or bodily harm
• Depicts or promotes illegal drugs or drug use
• Contains hate speech or discriminatory content
• Violates the intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates any applicable laws or regulations

6. Payment and Revenue Sharing

6.1 Revenue Share

Content Providers may earn revenue from subscriptions, tips, or other monetization features. Revenue share terms will be specified in your Creator Dashboard and may be updated from time to time with reasonable notice.

6.2 Payment Processing

All payments are processed through CCBill. You must comply with CCBill's terms and provide any information required for payment processing, including tax information.

6.3 Tax Obligations

You are responsible for all taxes related to your earnings. We may issue tax forms (such as 1099 forms for U.S. creators) as required by law.

7. Representations and Warranties

By uploading content, you represent and warrant that:

• You are at least 18 years of age
• All persons depicted in your content are at least 18 years of age
• You have obtained all necessary consents and model releases
• You own or have the rights to upload and distribute the content
• Your content does not violate any laws or third-party rights
• You comply with all record-keeping requirements under 18 U.S.C. § 2257
• All information you provide to us is accurate and truthful

8. Indemnification

You agree to indemnify, defend, and hold harmless Kink.io, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your content or any alleged violations of this Agreement
• Your violation of any laws or regulations
• Your violation of third-party rights
• False or inaccurate information you provide

9. Content Review and Removal

We reserve the right to:

• Review all content before it is published
• Remove any content that violates this Agreement or our policies
• Suspend or terminate your account for violations
• Report illegal content to law enforcement

10. Termination

Either party may terminate this Agreement at any time. Upon termination:

• You must cease uploading new content
• You may request removal of your existing content
• You will receive any outstanding payments owed to you
• Certain provisions (such as indemnification) will survive termination
